Terms of Submission
Last updated: 9 September 2026
These Terms of Submission apply when you submit an enquiry, manuscript, story, idea, draft, document or other material to FANPEN AFRICA LTD (“FanPen”, “we”, “us” or “our”) through our website or other official communication channels.
1. Your Right to Submit the Material
By submitting material to FanPen, you confirm that, to the best of your knowledge:
- you created the material or have the necessary permission or authority to submit it;
- your submission does not unlawfully infringe another person’s copyright, intellectual property, privacy or other rights; and
- you are entitled to ask FanPen to review or work with the material.
You remain responsible for the material you submit.
2. Ownership of Your Material
Submitting material to FanPen does not transfer ownership or copyright to FanPen.
Unless we later enter into a separate written agreement that states otherwise, you retain whatever rights you lawfully hold in your material.
3. Ideas and Similar Works
We understand that writers and creators may be concerned about sharing ideas before entering into a formal agreement.
However, general ideas, themes, concepts, subjects and approaches may be independently developed by different people. By submitting material to FanPen, you acknowledge that FanPen may already be working on, may later receive, or may independently develop material that is similar in theme, concept or subject matter.
Receipt of your submission does not, by itself, give you rights over independently created FanPen work or material submitted by another person.
Nothing in these Terms permits FanPen to copy or unlawfully use material protected by your copyright.
4. How We May Use Submitted Material
You give FanPen permission to receive, store, access and internally review the material you submit for purposes connected with your enquiry.
Where reasonably necessary, the material may be shared with members of our team or professional service providers involved in evaluating your enquiry or determining how FanPen may assist you.
This permission does not transfer ownership of your material to FanPen.
5. Confidential or Sensitive Information
Please do not submit information that you are not authorised to disclose.
If your project contains particularly sensitive, confidential or commercially valuable information, please tell us before sending extensive material so that we can determine whether additional arrangements are appropriate.
Submission through the website alone does not create a separate confidentiality or non-disclosure agreement.
6. Unlawful or Harmful Material
You should not knowingly submit material that is unlawful, defamatory, fraudulent, threatening, malicious or that unlawfully violates another person’s rights.
FanPen may decline to consider or work with material where we reasonably believe there may be legal, ethical or professional concerns.
7. Submission Is Not Acceptance
Submitting an enquiry or material to FanPen does not mean that FanPen has accepted your work for publication or agreed to provide a service.
It does not create a publishing agreement, commissioning agreement, editorial contract or other contractual relationship for the proposed work.
Any engagement will be subject to further discussion and, where appropriate, a separate agreement between you and FanPen.
8. No Obligation to Publish or Proceed
FanPen is not obliged to publish, edit, develop, produce or otherwise work with material simply because it has been submitted or received.
We reserve the right to accept or decline enquiries and proposed projects.
9. Personal Information
Personal information submitted through our website will be handled in accordance with our Privacy Policy and applicable data protection law.
